Who you are contracting with

MindBites is operated by Patricia Elliot (trading as MindCircles) (“we”, “us”). By using MindBites or buying a meditation through it, you agree to these terms. If you are under 18, please use MindBites with a parent or guardian.

What we provide

MindBites gives you short mindfulness, psychology and wellbeing videos free of charge, and full-length guided meditations that you can buy individually. Bought meditations stream inside the app for as long as we keep the service running.

Your account

You need an account so we can remember what you own. Keep your password confidential — you are responsible for activity on your account, and for giving us accurate details.

Acceptable use

You must not:

• use MindBites unlawfully, fraudulently or to send spam;
• copy, download, record, redistribute, resell or publicly perform our videos, or strip any technical protection from them;
• reverse engineer the service, scrape it, probe its security, or introduce malware.

Intellectual property

All meditations, audio, video, text, branding and software on MindBites remain the property of Patricia Elliot (trading as MindCircles). Buying a meditation gives you a personal, non-exclusive, non-transferable right to watch it for your own use — it does not transfer ownership or any licence to share it.

Payments

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax and refund mechanics are covered by Paddle’s Buyer Terms. Prices are shown before you confirm and include any tax Paddle is required to collect.

Refunds

See our refund policy — you have 30 days to change your mind, no reason needed.

Wellbeing disclaimer

MindBites is for general wellbeing and education. It is not medical, psychological or therapeutic advice and is not a substitute for care from a qualified professional. Do not use the meditations while driving or operating machinery. If you are unwell or in crisis, please contact your GP or emergency services.

Service level

We work hard to keep MindBites available, but we cannot guarantee uninterrupted or error-free access. To the fullest extent permitted by law we disclaim implied warranties of merchantability and fitness for a particular purpose.

Suspension and termination

We may suspend or end your access for material breach of these terms, non-payment, fraud or security risk, or repeated misuse. You can stop using MindBites at any time; meditations already bought remain available to your account while the service operates.

Liability

Our total liability to you is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect or consequential loss. Nothing here limits liability for fraud, death or personal injury caused by our negligence, or anything else that cannot be limited by law.

Governing law

These terms are governed by the law of Scotland, and the Scottish courts have jurisdiction.
